Terms of Service

These Terms of Service govern your access to and use of the AquaCraft website and any related service that links to them. AquaCraft is a brand operated by CARVON TRADE LLC. By using the site, you agree to these Terms. If you do not agree, do not use the site. Additional terms displayed for a specific feature or product also apply to that feature or product.

The current website is a static preview and does not yet complete live transactions or transmit the contact and newsletter forms to a production backend. Product displays and checkout interfaces may be tested locally, but no binding purchase occurs until AquaCraft enables live checkout and sends an order acceptance or shipment confirmation.

You must be legally able to enter a contract in your jurisdiction to make a purchase. If you use the site for an organization, you represent that you are authorized to bind it.

You are responsible for accurate account information, safeguarding credentials, and activity under your account. Notify AquaCraft promptly through the Contact page if you suspect unauthorized use.

We try to describe products accurately, but screen settings, photography, natural material variation, packaging changes, and manufacturer revisions can affect appearance. Dimensions and compatibility information are approximate unless expressly stated otherwise. Follow manufacturer instructions and confirm that a product is suitable for your tank, water type, livestock, and intended use.

Prices are shown in U.S. dollars unless stated otherwise and may change before an order is accepted. Products and quantities are subject to availability. We may correct errors in descriptions, prices, promotions, shipping charges, or availability. If a correction affects a submitted order, we may ask for confirmation or cancel and refund any captured payment.

Submitting an order is an offer to buy. An automated acknowledgement confirms receipt, not acceptance. AquaCraft may limit quantities or reject or cancel an order for reasons including inventory, suspected fraud, pricing error, shipping restriction, or payment authorization failure. If we cancel after payment is captured, we will refund the captured amount to the original payment method.

When live checkout is enabled, you authorize the displayed payment provider to charge the total shown at checkout, including applicable shipping and taxes. Available payment methods are those shown at live checkout and may vary by device, location, and provider. You are responsible for information needed to process the transaction lawfully.

Shipping estimates are not guaranteed delivery dates. The Shipping Policy and Returns & Refunds Policy form part of these Terms. AquaCraft's standard return request window is seven calendar days after delivery, subject to eligibility and any mandatory rights under applicable law.

You may not use the site unlawfully; interfere with its operation or security; probe or access systems without authorization; introduce malicious code; scrape or copy content in a way that burdens the service or infringes rights; impersonate another person; submit deceptive information; or use the site to violate another person's privacy, intellectual property, or other rights.

The AquaCraft name, site design, original text, graphics, logos, and other site content are owned by AquaCraft or used under license and are protected by applicable law. We grant you a limited, revocable, non-transferable right to use the site for personal shopping and information. No other license is granted.

Payment, shipping, hosting, social, and linked websites may be operated by third parties under their own terms and policies. AquaCraft does not control and is not responsible for independent third-party services, except to the extent responsibility cannot be excluded by law.

To the maximum extent permitted by law, the site and informational content are provided “as is” and “as available.” AquaCraft disclaims implied warranties that may lawfully be disclaimed. We do not warrant uninterrupted or error-free operation. Product warranties, if any, are those expressly provided with the product. Nothing here excludes a warranty or consumer right that cannot lawfully be excluded.

To the maximum extent permitted by law, AquaCraft will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits or data, arising from the site or products. For a claim related to a purchase, AquaCraft's aggregate liability will not exceed the amount you paid for the product giving rise to the claim. These limits do not apply where prohibited, including liability that cannot be limited under applicable consumer law.

To the extent permitted by law, you agree to indemnify AquaCraft from third-party claims, losses, and reasonable expenses arising from your unlawful misuse of the site, violation of these Terms, or infringement of another person's rights. This section does not apply to the extent a claim results from AquaCraft's own conduct.

Colorado law governs these Terms, without regard to conflict-of-law rules, except that mandatory protections of your home jurisdiction continue to apply. Any court proceeding will be brought in a court with lawful jurisdiction in Colorado unless applicable law gives you the right to proceed elsewhere.

If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remainder will continue. A failure to enforce a provision is not a waiver. These Terms and incorporated policies are the entire agreement about the site and replace prior statements on the same subject. You may not transfer your rights under these Terms without consent; AquaCraft may transfer them as part of a business transaction or by operation of law.

We may update these Terms for legal, operational, or service changes. The “Last updated” date identifies the current version.
